7th CPC Allowances Lavasa panel Committee submitted the report today to Finance Ministry


Lavasa said the government will take the final call on the date of payout of revised allowances to government employees
New Delhi, Apr 27 A high-level committee headed by the Finance Secretary submitted today its report on allowances to 47 lakh government employees to Finance Minister Arun Jaitley.

The Ashok Lavasa Committee was constituted in June last year after the government implemented the recommendations of the 7th Pay Commission.

The pay panel had recommended abolition of or subsuming of allowances like acting, assisting cashier, cycle, condiment, flying squad, haircutting, rajbhasha, rajdhani, robe, shoe, shorthand, soap, spectacle, uniform, vigilance and washing.

After submitting the report to Jaitley, Finance Secretary Ashok Lavasa said the committee has taken into account representations made by various stakeholders.

The report will now be examined by the empowered committee of secretaries and following that it will be placed before the Cabinet, he said.

Out of total 196 allowances, it had recommended abolition of 52 and subsuming of another 36 into larger existing ones.

The commission had recommended hiking the HRA in the range of 8-24 per cent.

If the pay commission recommendations on allowances are implemented fully, then as per estimates the cost to the exchequer will be Rs 29,300 crore.

        From time immemorial relentless battles are being waged against the slavery and misery of the humanity.  The rebellious flag of Spartacus against the Roman Empire, the heroic fight of Africans for generations together in search of Freedom from slavery, the flutters of red flag to save the human values which are under deadly attack on the anvil of industrial revolution.... all are noble struggles to stop the human exploitation.  19th Century stood mute witness to the bloody human history writ with oppression and suppression to maximize the profit at the cost of human lives.  Later part of the19th Century ushered in a new creed of slavery to machines.  The madness for profits peaked and the workers were reduced to the state of machines and the worker in the factory was a mere tool to earn profit for his master.  There were no definite working hours. There were no respect for labour.   There was no value for labourer.  It is not exaggeration to say that the smoke ridden factories sucked out the life of a labourer at the young age of mere 20 years.  This was the state of condition of workers world over.

          Many dreamt a great society free from exploitation; many wished for a society of eternal source of full realization of human potential in a pleasant and healthy environment; respect for labour, equal opportunities are the hall marks of a new ideal society.  Many dedicated their lives to realize their dream society.  Many more risked their lives to realize and reach that goal.  Every defining moment, every upheaval in the history was the result of the struggles waged by progressive  minds.  These are the struggles that steered and decided the course of history of mankind.

          At its national convention in Chicago, held in 1884, the Federation of Organized Trades and Labour Unions (which later became the American Federation of Labour), proclaimed that “eight hours shall constitute a legal day’s labour from and after May 1, 1856.”  Working class heroes of Hey Market embraced the hanging noose with smile on their lips.  The fight for eight-hour working day spread like a wild fire throughout the Continents.  European and Russian workers jumped into strikes and walked out of their factories.  In India for the first time Howrah Railway workers went on strike for working hours in the year 1882.  Later on Indian workers struck the work for more than 25 times on the demand of working hours between 1882 - 1890.  Eight-hour work; Eight-hour recreation; Eight-hour sleep had become the slogan of the workers worldwide.

          The struggle for eight-hour work has become a stepping-stone for future architect of a new society.  The thought itself is horrifying that, had those struggles not happened and but for their sacrifices what would have been our condition in the present day society!  How degrading it would be to have no control on our own lives?  The struggle for eight-hour work challenged that de-humanizing state annihilating all the atrocities, laid a solid foundation for building a better future society.  Thus, the struggle which appears simple and of no consequence for this generation, stood as a single cause for sweeping changes in the present day society.

          This May Day is the occasion for remembering reverently all the sacrifices and prepare to shoulder the responsibilities.  Still the exploitation is continuing.  Only deference is that the exploiter and exploitation has wrapped in sophistication!  The form of exploitation changed but the reason and essence remains the same.  This situation encompasses all the countries in the world.  The three decades of implementation of so called omnipotent new economic policies destroyed the economic fabric of our country. The country became dependent on foreign powers.  Our agriculture sector doomed. Monopoly of our farmers on their own seeds ceased.  Health and education is not within the reach of common man.  Wealth of the nation has been handed over to the private corporates for plundering.  Corporate Sector dented the jealously guarded right of 8-hour work. Now we will find casual and outsourced labour working for 12 hours a day. Technology has not ceased the drudgery of the worker.  Instead workload increased due to the ban on filling up of vacancies.  Unemployment and under-employment increased alarmingly. Central government employees are facing onslaught on their dignity by not honouring the assurance given on the minimum pay, fitment factor and allowances.  Attempts are afoot to weaken and render the unions and working class irrelevant.

          As the conscious workers, employees and citizens of this country, this May Day has manifolded our responsibilities.  The silenced voice of the Chicago Martyrs should explode in reverberation in the raised fists, throats and thoughts of millions of workers. Let’s march in unison with the inspiration of May Day!  Let’s protect our own rights and be part of that great effort to build a society of equality, justice and usher in peace and prosperity to the toiling millions of our countrymen.

CADRE RESTRUCTURING
IMPLEMENTATION DEFERRED

          Today on dated 25th April-2017, Com. R.N. Parashar Secretary General NFPE & General Secretary P-III alongwith Com. Giriraj Singh, President NFPE & General Secretary, R-III met with Shri B.V. Sudhakar, Secretary (Posts) and discussed issues of Cadre Restructuring and appraised him the difficulties being faced by the staff and requested either to modify the Cadre Restructuring as per suggestions submitted by NFPE & P-III or defer till the issues are settled. Secretary called DDG (Estt) Smt. Smriti Sharan & Director Estt. Shri S.V. Rao and ordered to form a committee of officers of Directorate which will take views of all Chief PMGs and after that Convening a meeting with unions, issues will be settled. Till then he ordered to keep the Cadre Restructuring implementation in abeyance

Sub: -  Offering GDS vacant posts to Casual Labourers before filling them by open market recruitment.

As per the clarification orders issued by Directorate on 17.05.1989 vide memo no. 45-24/88-SPB-I which was reiterated on 17.06.2016 vide Directorate memo no. 2-53/2011-PCC, all those working on casual basis are called casual labourers.

Directorate has issued clear instructions to all Circles to offer the vacant GDS posts, first to eligible casual labourers before resorting to open market recruitment. But contrary to the instruction of Directorate, many Circles have called for applications from open market candidates to fill up vacant GDS Posts, without offering the posts to eligible casual labourers. The open recruitment notification was issued on 02.01.2017 vide Directorate memo no. 17-23/2016-GDS.

As per the existing orders of the Directorate Casual labourers appointed prior to 01.09.1993 are eligible to apply for GDS posts and also MTS posts. In all Divisions, casual labourers appointed prior to 01.09.1993 are available, who satisfy the other eligibility conditions for recruitment also. By notifying entire GDs vacancies for open market recruitment, the department has denied the legitimate right of the casual labourers to get absorbed at least as GDS.

Further, it may be stated that the 10th Std. educational qualification for casual labourers is relaxed for recruitment to the post of MTS. Hence the same relaxation may be made applicable for recruitment of casual labourers in vacant GDs posts also.

It is once again requested to offer the GDS posts to eligible casual labourers, before resorting to open market recruitment.

Sub: -  Payment of arrears and revised wages from 01.01.2006 in respect of Postal Casual, Part time, contingent and daily-rated mazdoors.

1.      Your kind intervention is requested to redress the following genuine grievances of the most exploited and low-paid poor casual labourers of Postal Department. They are mostly unorganized and marginalized and hence your goodself alone can do justice to them.

2.      Department of Posts issued orders on 22.01.2015 (i.e.; two years back) for payment of revised wages to casual, Part-time, contingent and daily rated mazdoors working in the Postal department with effect from 01.01.2006, consequent on revision of minimum pay of Central Govt. employees by the Govt. as per the recommendations of 6th CPC.

3.      On receipt of the Directorate orders some Chief Postmaster General (Kerala, Andhra etc.) sought clarifications on two points. (1) who is a casual labour (2) to whom Directorate orders are applicable.

4.      Directorate issued detailed clarifications as follows:
Point No. – 1 – Who is causal Labour ?
Clarification vide Directorate order No. 45.24/88-SPB-I dated 17.05.2009 re0circulated in OM No. 2-53/2011-PCC dated 17.06.2016.
“It is hereby clarified that all daily wagers working in post offices or RMS offices or in Administrative offices or PSD’s/MMS under different designations (Mazdoors, casual labourers, contingent paid staff, daily wager, daily rated mazdoors, outsiders) are to be treated as casual labourers. Those casual labourers who are engaged for a period of eight (8) hours a day should be described as “full time casual labourers” and those who are engaged for a period less than eight (8) hours a day should be described as “part-time casual labourers”. All other designations should be discontinued”.

“the spirit of this Directorate’s OM dated 22.01.2015 is to allow revised remuneration to such full time-part time casual labourers, who have physically worked or who continue to work as such in that capacity, with no ambiguity whatsoever.”

The above two clarificatory orders issued by Directorate set at rest all the doubts regarding payment of revised wages to Casual labourers w.e.f 01.01.2006.

5.      But, we regret to inform you that, evenafter a lapse of two years the above orders are not yet implemented in many circles and divisions and eligible revised wages and arrers are not yet paid to the poor casual labouerers.

Eg: (1) Tamilnadu Circle has not yet implemented the Directorate orders dated 22.01.2015.
(2) West Bengal Circle – the order is not yet implemented in the case of casual labourers and daily rated mazdoors working in the divisions of Kolkata Metropolitian city and some other divisions.
(3) Maharashtra Circle – Nagpur Region
(4) Kerala Circle – for divisions pending.

Our representatives have discussed the case with the Circle/Regional Authorities several times but the administration is totally negative and adamant.

6.      In majority of the Circles and Divisions eventhough the revised wages are implemented, arrears for the period from 01.01.2006 is still pending. When contacted the reason stated is that funds are not revived from Directorate, eventhough Circle offices has submitted requisition for required funds to make payment of arrears.

7.      Further Directorate has already issued orders, again revising the wages of casual labourers with effect from 01.01.2016, consequent on revision of minimum pay of Central Govt. employees by the Govt. as per the recommendations of 7th CPC. The above orders is yet to be implemented in all Circles.

8.      In view of the above stated facts, it is once again requested that immediate action may be taken by the Directorate to
(a)   ensure implementation of 22.01.01.2015 orders revising the wages of casual labourers w.e.f 01.01.2006 in all the Circles/Divisions.
(b)   To allot sufficient funds for payment of arrears of wages w.e.f 01.01.2006 to all Circles.
(c)    To implement the orders revising the wages as per 7th CPC revision w.e.f 01.01.2016, in all Circles and division.

Without strict and time bound orders from Directorate, there is no chance for improvement in the present situation and the poor casual labourers will continue to be subjected to untold miseries.
